Article 1 - Purpose
These Terms of Service govern the use of the online copyright deposit service provided by Copyright01.com (hereinafter referred to as "the Service").
The Service enables users to deposit their intellectual creations in order to obtain a timestamped proof of prior existence, evidenced by a digital certificate.
Article 2 - Registration
Registration is free and open to any individual or legal entity. Users undertake to provide accurate information and to keep it up to date.
Each user is responsible for the confidentiality of their password and for all activity carried out from their account.
Article 3 - Description of the Service
3.1 - Copyright Deposit
Users may deposit intellectual creations in the form of files (text, image, audio, video, code) or website URLs. For each deposit, the Service:
- Computes a unique digital fingerprint (SHA-256)
- Timestamps the deposit with second-level precision (UTC)
- Stores the file in encrypted form (AES-256-CBC)
- Generates a downloadable PDF certificate
- Provides a public verification page
3.2 - Legal Value
The deposit certificate constitutes evidence of prior existence. In accordance with the Berne Convention (181 signatory countries), copyright arises automatically upon creation of the work. Depositing on Copyright01 enables you to prove the date on which you possessed this work.
This service does not replace filing a patent, trademark, or design with an official body (INPI, EUIPO, USPTO).
3.3 - Blockchain Anchoring (subscribers)
For subscribed users, the Service records the SHA-256 fingerprint of the Certified Folder in the data of a transaction on the Polygon network (0 POL self-transaction). This anchoring provides additional evidence, publicly verifiable on polygonscan.com, independently of Copyright01.
Blockchain anchoring does not constitute a qualified timestamp under the eIDAS Regulation (EU) 910/2014 and does not substitute for an authentic act. Its evidentiary value is subject to the sovereign assessment of competent courts.
Article 4 - Plans and Pricing
4.1 - Free Plan
Every registered user benefits from 3 included deposits with no expiration date at no cost. Free deposits remain accessible for as long as the Service is operational.
4.2 - Credit Packs
Credit packs are one-time purchases (non-recurring) of deposit credits. Each credit entitles the user to one certified deposit. Credits do not expire.
- Pack 5: 5 deposit credits : EUR 4.90 excl. VAT
- Pack 20: 20 deposit credits : EUR 14.90 excl. VAT
4.3 - Subscription
The Subscription provides up to 30 deposits per month, automatically renewed. Two plans are available:
- Monthly: EUR 9.90 excl. VAT/month
- Annual: EUR 79 excl. VAT/year (i.e. EUR 6.58/month)
Subscribers also benefit from files up to 500 MB, 10 GB storage, watermark-free certificates and priority support.
4.4 - VAT
All displayed prices are exclusive of tax (excl. VAT). VAT is calculated automatically by Stripe Tax based on the customer's country of residence, in compliance with the European Union OSS (One-Stop Shop) rules.
The publisher reserves the right to modify prices at any time. Any changes will be communicated to users and will only apply to future purchases or renewals.
Article 5 - Payment and Invoicing
Payments are processed by Stripe, a PCI-DSS certified payment provider. Copyright01.com does not store any banking data.
Invoices are automatically generated by Stripe and accessible from the user's account (under the "Billing" section of the profile).
Article 6 - Refund Policy
6.1 - Credit Packs
Credit pack credits are non-refundable once at least one credit has been used. If no credits have been consumed, a full refund may be requested within 14 days of purchase (see Article 7).
6.2 - Subscription
Subscription cancellation takes effect at the end of the current billing period. No prorated refund will be issued. The user retains access to all premium features until the end of the paid period.
6.3 - Payment Failure
In the event of a renewal payment failure, a 7-day grace period is granted. During this period, Stripe will make up to 3 automatic retry attempts. If payment ultimately fails, the subscription is cancelled and the user is reverted to the Free plan.
Article 7 - Right of Withdrawal
In accordance with Articles L221-18 et seq. of the French Consumer Code, the consumer has a 14-day period from the date of purchase to exercise their right of withdrawal, without having to provide reasons or incur any penalties.
A full refund will be granted provided that no deposits have been made using the purchased credits or features. If one or more deposits have been made, the right of withdrawal is deemed to have been waived due to full performance of the service.
To exercise this right, the user may contact customer service via the website's contact form.
Article 8 - Deposit Conservation
All deposits are preserved for a minimum of 10 years from the deposit date, regardless of the user's plan. In the event of subscription cancellation or credit exhaustion:
- Existing certificates remain valid and accessible
- Deposits remain verifiable via their public verification page
- Certification badges remain functional
- No deposits are retroactively deleted
The legal value of certificates depends on the persistence of evidence. Copyright01.com commits to retaining validated deposits for the full minimum period stated above. Beyond that period, deposits remain available for as long as the Service is operational.
Article 9 - Intellectual Property
Users remain the sole owner of their deposited creations. Copyright01.com does not acquire any rights over deposited works.
Users warrant that they hold the rights to the deposited creations and undertake not to deposit any unlawful, infringing, or third-party rights-violating content.
Article 10 - Liability
Copyright01.com undertakes to implement all necessary measures to ensure the availability and security of the Service. However:
- The Service is provided "as is" without any guarantee of results
- The publisher does not guarantee the admissibility of the certificate before any court of law
- The publisher shall not be held liable for indirect damages
- In the event of data loss, the publisher's liability shall not extend beyond restoring the Service
Article 11 - Termination
The publisher reserves the right to suspend or delete any account in the event of:
- Breach of these Terms of Service
- Deposit of unlawful content
- Fraudulent use of the Service
- Excessive consumption of Service resources
Article 12 - Governing Law and Disputes
These Terms of Service are governed by French law. In the event of a dispute, an amicable resolution shall be sought as a priority. Failing that, the courts of Besançon, France, shall have exclusive jurisdiction.
In accordance with Articles L611-1 et seq. of the French Consumer Code, consumers may have free recourse to the following consumer mediator:
